Terms of Service - DEDIBROS

This Terms of Service ("ToS" or "Agreement") governs your rental and use of dedicated servers ("Server" or "Servers") and related services ("Services") provided by Dedibros ("we," "us," or "our"). By using our Services, you ("Customer," "you," or "your") agree to these terms, presented in English. If you do not agree, you may not use our Services.

1. Services

Dedibros provides access to dedicated servers for rent, each consisting of physical hardware and network connectivity allocated exclusively for your use. We manage the physical hardware and network infrastructure; you are responsible for all software installation, configurations, and server management through remote access. We may modify, terminate or suspend Services at our discretion due to breaches of this Agreement

2. Account and Server Responsibilities

You must be a legally recognized individual or entity capable of entering contracts under applicable law to rent a Server. You confirm your authority to agree to these ToS and your compliance with all relevant laws.

By accessing or using our dedicated server services, you acknowledge that the following responsibilities are solely yours:

Maintaining the security of your account credentials and Server access details (e.g., passwords, SSH keys).
All activities that occur on your Servers, including any actions taken by third parties to whom you have granted access.
Notifying us in the event of unauthorized use or security breaches.
Managing all software, configurations, and content on your Servers.
Understanding that our company does not assume responsibility for customer-installed software, configurations, or content.

3. Prohibited Uses

Your Server use must comply with all applicable laws and these ToS. The following activities are strictly prohibited:

Hacking, distributing malware, or engaging in phishing.
Storing or distributing materials prohibited by law, such as unauthorized copies of copyrighted works, content inciting harm, or materials related to criminal activities.
Sending unsolicited spam emails or messages.
Conducting DoS attacks, port scanning, or disrupting our network.
Engaging in fraud or deceptive practices.
Hosting adult content or gambling-related materials.
Any activity that compromises the security or stability of our Services.

We determine violations at our sole discretion, and violating these terms may result in suspension or termination of your Account.

4. Payment and Billing

All Service fees are to be paid in advance each billing cycle (e.g., monthly) and are non-refundable unless required by law or otherwise stated in our Refund Policy. Late payments may result in suspension or termination of Server access. Pricing changes may occur at our discretion; continued use indicates acceptance.

5. Suspension and Termination

By Us: We may suspend or terminate Server access if you violate this ToS, fail to pay, compromise security, disrupt our network, or if required by law. Upon termination, data may be deleted without liability.

By You: You may cancel your rental via the client area on our website. Email cancellations are not accepted. Refunds, if processed, exclude setup fees and are only issued if required by law, or eligible according to our refund policy.

6. Support Limitations

Dedibros provide technical support for:

Hardware failures and physical component malfunctions.
Network connectivity issues within our infrastructure.
Basic operating system reinstallations upon request (subject to availability).

Dedibros does not provide assistance with software installation, configuration, optimization, or troubleshooting. We do not offer application support, security hardening, performance tuning, or assistance with third-party services or integrations. You are solely responsible for all aspects of server management beyond the physical hardware and network connectivity, including but not limited to data backup and recovery, security updates, and software maintenance.

7. Intellectual Property and Data Responsibility

You own all data and software you place on the Servers and are solely responsible for their legality, integrity, and compliance with applicable laws. You grant us a limited, non-exclusive license to access and manage them solely to provide the Services. We provide and control the physical hardware, which remains under our authority, and grant you a non-exclusive license to use the Servers remotely during this Agreement.

8. Data and Backups

You are responsible for securing and backing up your Server data. We do not provide backups unless specified in your plan. We are not liable for data loss due to hardware failure, user error, or other causes. Maintenance may cause downtime, with advance notice when possible.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages (e.g., lost profits, lost data, or business interruption) arising from your use of the Services. Our total liability, whether for direct or indirect claims, is limited to the fees you paid for the Servers in the prior 12 months.

10. Disclaimer of Warranties

Servers and Services are provided "as is" with no guarantees of uninterrupted or error-free operation.

11. Indemnification

You will indemnify Dedibros against claims or losses from your Server use, including ToS violations or legal breaches, by you or anyone you allow access.

12. Governing Law

These Terms shall be governed by and interpreted under the laws of the jurisdiction where Dedibros is headquartered, excluding its conflict of law rules.

13. Miscellaneous

We may update this ToS with or without notice via email or our website. Continued use after changes signifies your acceptance.

These Terms constitute the entire agreement between you and Dedibros regarding the Services and supersede all prior and contemporaneous agreements, proposals, or representations, concerning their subject matter. No modification, amendment, or waiver of any provision of these Terms shall be effective unless in writing and signed by an authorized representative of Dedibros. Any prior communications, promises, or agreements, whether oral or written, regarding the Services are hereby superseded and have no legal effect.
